Terms of Use

These Terms of Use (the "Terms") govern your use of the iOS app "ReadItWiser" and its related website (together, the "Service") provided by qooq inc. ("we", "us", or "our"). By using the Service, you are deemed to have agreed to these Terms.

1. Application

These Terms apply to the relationship between you and us regarding your use of the Service. The Service is distributed through Apple's App Store, and you also agree to be bound by Apple's applicable terms.

2. Account and environment

• The Service issues an anonymous identifier automatically at launch. No name, email address, or other registration is required.
• Your account is tied to your device and recovery information. Deleting the app or changing devices may make data that is not synced to the cloud (such as highlights and notes) inaccessible.
• Some features require a device/OS that supports Apple Intelligence, a network connection, or an active subscription/ticket.

3. The Service

The Service lets you save web articles, extract article text, read offline, and search full text, with two layers of AI assistance: on-device Apple Intelligence (summaries, tags, scoring, and translation) and cloud GPT-5.4-mini (critical-reading analysis). Features and specifications may change without notice.

4. AI disclaimer

• AI outputs such as summaries, scores, tags, analysis, and translation may contain errors, omissions, or bias. We do not guarantee the accuracy, completeness, or usefulness of these outputs.
• AI outputs are not legal, medical, financial, investment, or other professional advice. You are responsible for verifying primary sources before making important decisions.
• Cloud AI analysis may cover only the opening portion of an article (up to the first 16,000 characters) and is not an evaluation of the entire article.
• AI features depend on external services (OpenAI / Apple); we do not guarantee their continued availability, quality, or operation.

5. Fees, subscriptions, and tickets

Paid features are provided through App Store in-app purchases.

• Pro (monthly auto-renewing subscription): includes ad-free use, automatic AI analysis for all items, a monthly GPT analysis quota, and a bonus on ticket purchases. A free trial may be offered for the first term.
• Analysis ticket (one-time, consumable): purchases additional GPT analysis quota, available whether or not you have a subscription. As a consumable, unused portions are generally non-refundable after purchase.

The terms of an auto-renewing subscription are as follows:

• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription renews automatically, and a renewal charge is applied, unless auto-renew is turned off at least 24 hours before the end of the current period.
• You can manage or cancel renewal at any time after purchase from your device's Settings > Apple ID > Subscriptions.
• If a free trial is offered, not cancelling during the trial will automatically move you to the paid subscription at the end of the trial. Any unused portion of a free trial is forfeited when a subscription is purchased.
• Prices may change due to exchange rates, taxes, or changes to what is offered. Displayed prices and currency follow your App Store region.

Purchases and refunds are processed by Apple. Refunds follow Apple's policies, and we may be unable to handle them directly.

6. Prohibited conduct

When using the Service, you must not:

• violate any law or public order and morals;
• reverse engineer, decompile, modify, or gain unauthorized access to the Service;
• abuse the API, send excessive automated requests, circumvent usage limits, or fraudulently re-obtain free trials;
• place an excessive load on the Service's servers or network;
• save or share content that infringes the intellectual property, privacy, or other rights of third parties; or
• engage in any other conduct that we reasonably deem inappropriate.

7. Intellectual property

Rights in the Service and related software, designs, and trademarks belong to us or our rightful licensors. Copyright in articles you save belongs to the respective rights holders. You may use such content only within the scope permitted by applicable law (such as private use), and must not reproduce or redistribute it without the rights holder's permission.

8. Disclaimer / no warranty

• The Service is provided "as is". We make no warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, continuity, or freedom from errors or interruptions.
• Features such as text extraction, offline saving, AI analysis, translation, and notifications may be unavailable depending on the target site, external services, or your device environment.
• The Service depends on external services (Apple / Google / OpenAI, etc.), and features may be affected by changes to or suspension of their terms.

9. Limitation of liability

To the extent permitted by applicable law, we are not liable for indirect, special, or consequential damages, or lost profits, arising from the use or inability to use the Service. Where we are liable, our liability is limited, to the extent not contrary to applicable law, to the amount you paid for the Service in the 12 months preceding the event giving rise to the liability.

10. Changes, suspension, and termination of the Service

We may change, suspend, or terminate all or part of the Service without prior notice. Our liability for any resulting harm is limited as set out in the preceding section.

11. Changes to these Terms

We may revise these Terms as needed. If there is a material change, we will announce it in the app or on this page. If you continue to use the Service after a change, you are deemed to have agreed to the revised Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of Japan. Any dispute between you and us relating to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

13. Apple App Store notice

When you use the Service through Apple's App Store, the following applies:

• These Terms are between you and us; Apple is not a party. We, not Apple, are responsible for the Service and its content.
• We are responsible for providing the Service and its maintenance and support. Apple has no obligation to furnish any maintenance or support for the Service.
• If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may (where applicable) refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
• We are responsible for addressing product claims (including product liability, failure to conform to legal requirements, consumer-protection claims, and claims arising from AI outputs).
• If a third party claims that the Service infringes intellectual property rights, we are responsible for the investigation, defense, settlement, and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government prohibited or restricted-party list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you.
